1. Consent to electronic records
By accepting this consent, you agree that Arch Ventures LLC, doing business as ScaleKit Financing, may provide agreements, disclosures, notices, authorizations, records, confirmations, application communications, and other documents relating to the Services electronically. Electronic delivery may occur through the website, application, email, text message containing a link, or another electronic method you authorize.
2. Electronic signatures
You agree that clicking an acceptance button or checkbox, typing your name, submitting the application, or otherwise applying an electronic symbol or process with intent to sign constitutes your electronic signature. Your electronic signature has the same legal effect as a handwritten signature to the extent permitted by law.
3. Scope
This consent applies to the ScaleKit application, Terms of Use, Privacy Policy acknowledgments, Notice at Collection, credit authorization, provider-sharing authorization, transaction records, amendments, and communications related to your inquiry. A financing provider may require a separate E-Sign consent for its own documents.
4. Hardware and software requirements
To receive and retain electronic records, you need a current internet browser capable of displaying HTML and PDF files, an active email address, a device with internet access, sufficient storage or printing capability, and software capable of viewing PDF documents. You must keep your email address and other contact information current.
5. Paper copies
You may print or save electronic records when presented. You may request a paper copy of a ScaleKit-controlled record by emailing funding@scalekitfinancing.com. ScaleKit may charge a reasonable copying or mailing fee only if disclosed in advance and permitted by law. Provider-controlled records must be requested from the applicable provider.
6. Withdrawal of consent
You may withdraw consent to future electronic records by emailing funding@scalekitfinancing.com with the subject “Withdraw E-Sign Consent.” Withdrawal is effective after a reasonable processing period, does not affect the validity of prior electronic records or signatures, and may prevent ScaleKit from continuing a digital application if electronic delivery is required to provide the service.
7. Contact updates and confirmation
You must notify ScaleKit if your email address or other electronic contact information changes. By accepting this consent, you confirm that you can access the disclosures presented in the application and can retain them electronically or print them.
